Prenuptial & Postnuptial Agreements

A prenuptial agreement is an agreement between two parties before they are married. A post-nuptial agreement, on the other hand, is an agreement between the parties after they are married. In both cases the agreement relates to how the parties' assets and property will be treated during their marriage, upon divorce, or at the death of a spouse.

In Arizona, a prenuptial/postnuptial agreement is a written contract which defines and identifies each spouse's separate property and community property. It will also specify how community property is accumulated during the marriage, if at all. Not every agreement will be upheld by a court. In order to be valid, the  agreement must be both drafted properly and executed under the correct circumstances.
